Tax clearance and the TCS PIN
The Tax Compliance Status PIN replaced the old paper certificate. It is a live status, not a document, which is why it is best kept green permanently rather than chased the week a tender closes.
How the TCS system works
SARS replaced the printed tax clearance certificate with the Tax Compliance Status system. Instead of a certificate valid for a year, you are issued a PIN. You give the PIN to whoever needs it, and they use it to view your compliance status on SARS eFiling at any moment they choose to look.
This is the part businesses underestimate. The status is live. A PIN issued today shows compliant today, and shows non compliant the moment an EMP201 goes unfiled or a VAT payment is missed, even mid tender. Whoever holds your PIN sees that change without you being told.
What SARS checks
Your status turns non compliant if any of the following is true:
- You are not registered for a tax type you are legally required to be registered for
- Any return is outstanding across income tax, VAT, PAYE, provisional tax or dividends tax, including nil returns
- There is a debt owed to SARS that is not under an approved payment arrangement or suspension
- Your registered particulars are out of date, including the registered representative
Note that a debt under an approved arrangement does not break compliance. Businesses that assume a balance owing means an automatic refusal often have more options than they realise.
The three types of TCS
- Good standing. The general purpose confirmation, used for tenders, contracts, vendor onboarding and licence applications.
- Tender. Requested specifically for a bid. Most organs of state now verify status through the central supplier database as well.
- Foreign investment allowance and emigration. Used to move funds offshore beyond the discretionary allowance. This one requires substantially more supporting information, including a statement of assets and liabilities and the source of the funds, and it takes longer.
Where it goes wrong, and the timing trap
Where everything is filed and paid, the PIN issues through eFiling within roughly 24 to 48 hours. Where something is outstanding, it can take weeks, because the underlying problem has to be fixed first and SARS has its own turnaround times on returns and account queries.
The pattern we see repeatedly is a business that discovers on Monday that a tender closes Friday and requires a TCS PIN. If there are three unfiled EMP501s behind it, that deadline is not going to be met, and the opportunity is simply lost. There is no expedited route.
The answer is not a faster application process. It is keeping the underlying compliance current continuously, which is what a monthly plan does, so a PIN is a two day administrative step whenever it is asked for.
What we do
First we pull your full SARS statement of account across every registered tax type, which usually reveals things you did not know about, including old registrations that were never deactivated and are quietly accruing non compliance. Then we file whatever is outstanding, apply for remission of the administrative penalties that qualify, and where there is a balance we negotiate a deferred payment arrangement so the debt stops blocking your status.
Once compliant, we issue the PIN and give you the reference to pass on. From then on we monitor it, because a status that was green when you handed the PIN over is worth very little if it turns amber in month three.
Scope
What you get

Outstanding returns filed
Whatever is missing, filed in the correct sequence so the account clears properly.
Penalties challenged
Remission applications lodged on the grounds available rather than paying automatically.
Payment arrangements
Where a balance exists, a deferred arrangement negotiated so it stops blocking your status.
PIN issued
The TCS PIN produced and the reference given to you to pass on.
Status monitored
Ongoing monitoring so the status stays green while somebody is holding your PIN.
Questions
Tax clearance: common questions
What is a TCS PIN?
The Tax Compliance Status PIN is what replaced the old paper tax clearance certificate. You share the PIN and the recipient views your live compliance status on SARS eFiling. It is a live status rather than a fixed document, so it can change after you have handed it over.
How long does tax clearance take?
Where every tax type is filed and paid, the PIN typically issues within 24 to 48 hours through eFiling. Where returns are outstanding or there is unarranged debt, it takes weeks because the underlying non compliance must be resolved first. There is no expedited route.
Can I get tax clearance if I owe SARS money?
Yes, provided the debt is under an approved payment arrangement or the payment has been suspended pending a dispute. A balance owing does not by itself make you non compliant. An unarranged balance does.
Why did my tax clearance status change to non compliant?
Because something changed on your SARS profile after the PIN was issued: a return fell due and was not filed, a payment was missed, or your registered particulars went out of date. The status is live, so anyone holding your PIN sees it immediately.
Do I need tax clearance for a government tender?
In practice yes. Organs of state verify tax compliance status, usually through the central supplier database as well as the PIN. A non compliant status will disqualify a bid regardless of its merits.
What is a foreign investment allowance TCS?
A separate application used to transfer funds offshore beyond the discretionary allowance. It requires more supporting information, including a statement of assets and liabilities and evidence of the source of funds, and it takes longer than a good standing application. We handle these too.
